Sonia Sotomayor Resigns from Belizean Grove (Women’s Group), Still Hasn’t Resigned from La Raza

SCOTUS nominee Sonia Sotomayor has quite her membership in the Belizean Grove–a group that restricts its membership to women only. That sounds an awful lot like discrimination to me.

Let’s check the legal definition of invidious discrimination:

Invidious discrimination applies a differentiation scale to people who belong or who appear to belong to certain groups. This type of discrimination is an unfair and often illegal practice that can go on daily in many different forms. Invidious discrimination is often committed based on age, gender, sexual orientation, race, skin color, religion, social status, abilities, physical characteristics, mental illness, and more.

Invidious discrimination is a form of distinction that makes a line between one group and another group. The group discriminated against is generally seen as being lacking, lower, or deficient in some way. An individual, group, political body, or business can practice invidious discrimination. (Boldness mine)

It seems to me that excluding someone on the basis of gender precisely fits the definition of invidious discrimination. What does Judge Sonia Sotomayor, the so-called brilliant legal mind, think?

“I believe that the Belizean Grove does not practice invidious discrimination and my membership did not violate the Judicial Code of Ethics, but I do not want questions about this to distract anyone from my qualifications and record,”

Well, Your Honor, simply because you don’t believe your group doesn’t practice invidious discrimination doesn’t mean it isn’t happening. After all, in law it doesn’t matter what one believes, it only matters what one can prove.

Can you prove the Belizean Grove doesn’t engage in invidious discrimination? Clearly you’re concerned about this or else you wouldn’t have resigned.

Now the question must be asked, why won’t Judge Sotomayor quit her membership in La Raza (translated: “The Race”)?–the Hispanic organization that obviously believes in racial superiority simply by its title?

Ask yourself that, boys and girls.
